Terms & Conditions

Goods means the blinds, window furnishings or other products manufactured or supplied by Home Sensations Ltd and the subject of the order made by You.
You and Your means the person ordering Goods from Home Sensations Ltd.
Home Sensations Ltd or We or Us or Our means Home Sensations Ltd trading Home Sensations Ltd.co.uk.


1. OUR CONTRACT

Our website invites You to buy Goods from Us. A legally binding contract with You will only arise once Home Sensations Ltd has received payment for the Goods in full from You. We shall notify You of acceptance of Your order by e-mail to the e-mail address given by You in the order form. We regret We cannot accept orders placed by persons located or resident outside of the United Kingdom.


2. PRICE

2.1 The price for any Goods ordered by You will be the price shown on the order confirmation section of the home-sensations.co.uk website at the time You place Your order and will include all taxes applicable from time to time.
2.2 In addition to the price, a delivery charge will be payable in respect of deliveries made to locations within the UK mainland other than orders for samples. The delivery charge will be that shown on the order confirmation section of the home-sensations.co.uk website at the time You place Your order. If there is any change in the delivery charge payable We will notify You before Your order is accepted by Us and ask You to confirm that You wish to proceed with Your order. If there is any change in the delivery charge payable We will notify You before Your order is accepted by Us.
2.3 Subject to clause 6, We will debit the price, plus any delivery charge, from Your debit or credit card when We receive Your order or as soon as reasonably practicable thereafter. If more than one item is ordered We may deliver the Goods in instalments but, if We do, We will not charge more than one delivery fee.


3. RIGHT FOR YOU TO CANCEL YOUR CONTRACT

3.1 Subject to clause 3.2, You may cancel Your order with Us for the Goods(ready made)  You order at any time up to the end of the seventh working day from the date You receive the Goods that you have ordered. You do not need to give Us any reason for cancelling Your order. To cancel Your order You must notify Us by e-mail at customerservice@home-sensations co.uk with Your order number or call the telephone order help-line on 0870 922 2153 with Your order number or write to us at Home Sensations Ltd, Unit F Marconi Courtyard, Brunel Road, Corby, Northamptonshire, NN17 4LT. Please note that custom specific i.e. made to measure products cannot be cancelled one they have entred the manufacturing process.
3.2 If You have received the Goods before You cancel Your order under clause 3., please contact Us as soon as possible by e-mail for guidance on how to return Your goods. You shall be liable for their own carriage costs.    When returning goods, please ensure that they are packed sufficiently because we cannot accept goods that are damaged during their return. Damages due to insufficient packing will need to be claimed by you, from the company used to send the goods back to us. Customers must arrange own carriage for the return of goods. Please note that refunds will be for goods only and will not include any carriage costs paid to us.
3.3 You cannot change or cancel Your order if the Goods You have ordered are manufactured, measured or custom-made to Your requirements or specifications as these Goods will not be resaleable by Us. We regret that once Your order has been accepted by Us in relation to such Goods and entered on Our manufacturing process We are unable to accept any changes to these Goods or cancellation of Your order.
3.4 Subject to the provisions of clause 3.2, once You have notified Us that You are cancelling your order, any sum debited to Us from Your debit or credit card will be recredited to Your account as soon as possible and in any event within 30 days of cancellation of Your order provided that the Goods in question are returned from You and received by Us in the condition they were in when delivered to You and have not be


4. CANCELLATION BY US

4.1 We reserve the right to cancel Your order if:
4.1.1 We have insufficient stock to deliver the Goods You have ordered
4.1.2 You require delivery outside the United Kingdom or
4.1.3 one or more of the Goods You ordered was listed at an incorrect price due to a typographical error or an error in the pricing information made by Us and/or received by Us from Our suppliers.
4.2 If We do cancel Your order We will notify You by e-mail and will re-credit to Your account any sum deducted by Us from Your debit or credit card as soon as possible but in any event within 30 days of Your order. We will not be obliged to offer any additional compensation for disappointment suffered.


5. STOCK SHORTAGES

If the Goods or the fabric You order are unavailable We will notify You as soon as possible and suggest a suitable replacement or you will be entitled to cancel Your order.


6. PRODUCT DESCRIPTIONS AND MEASUREMENT

6.1 The product information and photographs contained within Our website are provided for illustrative purposes only and We cannot warrant that they are accurate. If You are in any doubt as to the precise nature of the product or fabric You wish to order, You are advised to order a free sample of the product.

6.2 Whilst every attempt will be made by Home Sensations Ltd ensure that the Goods sold and delivered match in every respect any sample or description shown or given or sent to You, any minor or immaterial variation or change in colour or pattern between the sample or description and the Goods delivered shall not entitle You to reject the Goods nor to claim any compensation for such variation or change.


7. DELIVERING YOUR GOODS
Home Sensations employs City Link, ParcelForceFastway Couriers to deliver your order. Delivery for ready made prodcuts is within five working days (Monday – Friday, excluding Bank Holidays), although we aim to despatch all orders within 24 hours for next working day delivery. Please note, that if for some reason the item(s) you have ordered are unavailable we will contact you, as soon as we become aware, by phone or e-mail to let you know. At this point you have to choice to amend or cancel your order.
Delivery for mad to measure prodcuts is 5-7 working days.

Delivery is charged at £ 4.99 per order for most parts Britain. Deliveries to Northern Ireland, the English Islands, and offshore Scotland and Scottish Highlands will incur additional charges. Delivery to these can take an additional 2 –3 days. Please see the Delivery section to see the breakdown of these costs.

Deliveries for Southern Ireland are charged at £ 40.95.

At the moment we cannot deliver to any BFPO addresses.

All orders will be despatched within 5 working days. Your order status will be changed to “Despatched” when shipped.

Please note when placing your order make sure the delivery address is where someone will be available to sign for your parcel(s). City Link / Fastway Couriers will not automatically leave the parcel without a signature or leave it with a neighbour unless this is requested. We can deliver to your work/friends address. In the event that you cannot have your order delivered to your work address and you will not be in at your Home Address you can instruct us to leave your order with a neighbour, any instructions like this must be entered into the delivery instructions whilst checking out.

If you are not in at the time of delivery City Link/Fastway Couriers will leave a card and it will be your responsibility to contact City Link/Fastway Couriers immediately to arrange a new delivery date. If they do not hear from you then they will automatically attempt delivery the next working day. If you are not in then you will need to contact the courier to arrange collection or a chargeable third delivery of £ 4.40. You will have 5 days to contact City Link/Fastway Couriers otherwise the parcel will be returned to us. In this event a charge of £ 11.95 will be made to us and unfortunately we will have to pass this onto you when re-delivery is arranged again. When taking receipt of your order please take the time to check for any damage, if this is not possible please sign for it as "un-checked" to prevent voiding your insurance. If this is not done then you are signing for the goods as "received in good condition" and we will not be able to make any claims for damage. If you have arranged for anybody else to accept your order, then please ensure you advice them of the above. If your items arrive damaged and you have signed for them as "damaged" or "un-checked" then we will supply like for like replacements, we will never deviate from the original size/colour etc.

8.1 FAULTY GOODS
Goods damaged in transit by our carrier or goods sent in error will be replaced, an alternative sent or a refund made – whichever you prefer.  In the case  of made to measure products we only ever arrange like for like replacements and never deviate from the original order. Please note that slight colour variations are not considered a fault, especially with natural colours. This does not affect your statutory rights.

9. EVENTS BEYOND OUR CONTROL
We shall have no liability to You for any failure to deliver Goods You have ordered or for any delay in doing so or for any change of the specified delivery date or for any damage or defect to Goods delivered that is caused by any event or circumstance beyond Our reasonable control including, without limitation, third party default, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, abnormal weather  or accident.


12. INVALIDITY

If any part of these terms and conditions is unenforceable (including any provision in which We exclude our liability to You) the enforceability of any other part of these conditions will not be affected.


13. PRIVACY

We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you so that we can process your enquiry/order and secondly, so that we can provide you with the best possible service.

We will never pass your details on to any third party without your permission.

The information that we will collect about you includes: Your name, address, phone number and e-mail address.

We will never collect sensitive information about you without your consent. The information that we hold will be accurate and up to date. You can check the information that we hold about you by writing to us. Should you find any inaccuracies, we will correct it or delete it promptly.
We may use ‘cookies’ to help us track the patterns of behaviour of visitors to our site in order to help us make improvements. These cookies do not contain any personal information and you can adjust your browser settings to restrict the use of cookies if you wish.


14. THIRD PARTY RIGHTS

Except for Our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.


15. GOVERNING LAW
This contract is subject to English law and the exclusive jurisdiction of the English courts
16. Returns Policy - Ready Made Products
In the unlikely event that you are not satisfied with your item/s you have the right to return unopened goods within 7 days from date of receipt if not satisfied and you will be liable for their own carriage costs. The item/s must be returned in the same condition as received. When returning goods, please ensure that they are packed sufficiently because we cannot accept goods that are damaged during their return. If the goods are damaged when returned to us it is your responsibility to claim from the company used to send the goods back to us. Customers must arrange own carriage for the return of goods. Please note that refunds will be for goods only and will not include any carriage costs paid to us. We shall never accept returns when the goods have been trimmed or altered - it is the customer’s responsibility to check for any damages prior to making alterations.
Faulty goods, goods damaged in transit by our carrier or goods sent in error will be replaced.
 
17. Returns Policy - Made To Measure Products
 
Returns are no accepted for made to measure products, if a product arrives damaged then Home Sensations Ltd will replace the product on a like for like basis only, we will never deviate from the original order.
